1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Nawix Games ("we," "us," or "our") regarding your use of our mobile games, websites, and related services (collectively, the "Services").

By downloading, installing, or using any of our games, you confirm that you are at least 13 years of age (or the minimum age required in your country) and that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are under the age of majority in your jurisdiction, you must have obtained verifiable parental or guardian consent before using our Services.

2. Definitions

For the purposes of these Terms:

• "Account" means any account you create when accessing our Services.
• "Services" means our games, products, content, and websites operated by us.
• "Virtual Items" means any in-game currency, coins, tokens, points, or virtual in-game items available through our Services.
• "User Content" means any data, feedback, or content you share or create through our Services.

3. Licence to Use Our Games

Subject to your compliance with these Terms, Nawix Games grants you a limited, non-exclusive, non-transferable, revocable licence to download and use our games for your personal, non-commercial entertainment purposes.

This licence does not include the right to:

• Copy, reproduce, modify, or create derivative works of our games
• Distribute, sell, rent, lease, or sublicense our games to third parties
• Reverse engineer, decompile, or disassemble any part of our games
• Remove or alter any proprietary notices, labels, or marks in the games
• Use our games for any commercial purpose without our prior written consent
• Use cheats, bots, automation tools, or any unauthorised third-party software to modify game data or gain an unfair advantage

4. Intellectual Property

All content included in or made available through our games — including but not limited to text, graphics, logos, icons, sounds, music, artwork, animations, code, and game design — is the exclusive property of Nawix Games or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

The "Nawix Games" name, logo, and all related product names are trademarks of Nawix Games. You may not use any of our trademarks without our prior written permission.

Nothing in these Terms grants you any ownership of or intellectual property rights in our games or content beyond the limited licence described above.

5. Ownership of Virtual Items

Any Virtual Items you earn or purchase through our Services are not your property. Virtual Items are owned by Nawix Games, and you are granted only a limited, revocable licence to use them while we offer the Services.

You may not transfer, sell, trade, or exchange Virtual Items outside of the Services. Any such transfer or attempted transfer is prohibited and void. We reserve the right to terminate your access if you attempt to do so.

To keep our Services optimised, we may delete accounts and associated Virtual Items that have been inactive for 180 days.

6. User Conduct

When using our Services, you agree not to:

• Violate any applicable local, national, or international laws or regulations
• Impersonate any person or entity
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
• Attempt to gain unauthorised access to our systems, servers, or networks
• Introduce viruses, trojans, worms, or other malicious or harmful code
• Use the Services to send unsolicited communications or spam

7. In-App Purchases

Some of our games offer optional in-app purchases. All purchases are processed through the applicable platform store (Apple App Store) and are subject to their respective terms and policies.

You do not legally own any Virtual Items you purchase. Any virtual currency balance shown in your account does not constitute a real-world balance or stored value, but reflects only the extent of your limited licence.

8. Advertisements

Our games may display advertisements provided by third-party advertising networks. These ads are governed by the terms and privacy policies of the respective ad networks. We are not responsible for the content of third-party advertisements or for any products or services they promote.

9. Feedback and Suggestions

We welcome your feedback. However, any ideas, suggestions, or feedback you voluntarily submit to us shall be considered non-confidential and non-proprietary. We may use such feedback freely without any obligation to you.

10. Availability of Services

We make no promise that our Services will always be available, uninterrupted, or error-free. We may suspend, withdraw, or restrict the availability of all or any part of our Services for business and operational reasons at any time without notice.

We reserve the right to discontinue any game or part of a Service permanently or temporarily. If this occurs, we are not obligated to provide refunds, benefits, or other compensation for discontinued elements of the Services or for Virtual Items previously earned or purchased, unless required by applicable law.

11. Disclaimer of Warranties

We do not warrant that:

• Our games will be uninterrupted, error-free, or free of viruses or other harmful components
• Any defects or errors will be corrected
• The games will meet your requirements or expectations
• Results obtained from using the games will be accurate or reliable

12. Limitation of Liability

To the maximum extent permitted by applicable law, Nawix Games shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your use of, or inability to use, our games — including but not limited to loss of data, loss of profits, or loss of goodwill — even if we have been advised of the possibility of such damages.

In no event shall our total cumulative liability to you exceed the greater of the amount you paid to us in the twelve months prior to the event giving rise to the claim, or USD 10.00.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Nawix Games from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or relating to your use of the Services or your violation of these Terms.

14. Third-Party Links and Services

Our games or website may contain links to third-party websites or services. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. Your interactions with third-party sites and services are governed solely by their respective terms and policies.

15. Termination

We reserve the right to suspend or terminate your access to our games at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion. Upon termination, the licence granted to you under these Terms will immediately cease and you must stop using our games.

16. Force Majeure

We are not liable for any failure or delay in performance resulting from causes outside our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, government actions, fire, floods, accidents, network or infrastructure failures, strikes, pandemics, or shortages of energy or materials.

17. Assignment

We may transfer our rights and obligations under these Terms to another person or entity at any time without your consent, for example in the case of a sale or transfer of our business. You may not transfer your rights or obligations under these Terms to anyone without our prior written consent. Any attempt to do so without our consent is void.

18. No Waiver

If we do not enforce any right or provision under these Terms, that does not mean we are waiving that right permanently. Any waiver by us must be made in writing and does not mean we will automatically waive the same right in the future.

19. Notices

20. Language of Terms

These Terms are written in English. If a translated version is ever made available, it is for informational purposes only. In the event of any conflict between a translated version and the English version, the English version shall prevail.

21. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in the relevant jurisdiction. For users located outside the United States, disputes shall be brought in the courts of Bangalore, India unless both parties agree to another location.

22. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary. The remaining provisions of these Terms shall continue in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nawix Games with respect to your use of our games and supersede all prior agreements and understandings relating to the same subject matter.
